Thirty-nine real estate research priorities are assessed, with much closer alignment for real estate research priorities in the U.K., Germany and Australia than seen for the U.S. The role of real estate in a mixed-asset portfolio and real estate and portfolio risk management figure prominently amongst the general real estate research priorities. The top specific real estate research priorities were the impact of capital flows, real estate cycles and real estate portfolio diversification. The underlying general real estate research priorities “dimensions” highlight the strategic issues involved in real estate research, particularly the changing real estate environment, strategic real estate issues and the role of real estate in the portfolio.Real estate research has taken on increased importance in recent years in the international arena. The establishment of the regional real estate societies (particularly ARES, ERES, PRRES and AsRES) and their annual conferences have been key catalysts to this expanded real estate research agenda, with much of this research having a strong real estate industry focus. As such, general real estate research areas have been identified by leading real estate academics in the United States and the United Kingdom (Lusht, 1993; Webb, 1997; Jaffe, 1998; Crosby, 2000; Worzala, 2002; and Adair, Crosby, Lim and Watkins, 2003), as well as by leading U.S. and Australian real estate practitioners (Winograd, 1999; Souza, 2000; Parker, 2001; and Steinert and Crowe, 2001).To more fully assess the real estate research directions and priorities for U.S. institutional investors, extensive real estate industry surveys have been funded by the National Council of Real Estate Investment Fiduciaries (NCREIF) in 1992 (Ziering and Worzala, 1997) and the Pension Real Estate Association (PREA) in 2000 (Worzala, Gilliland and Gordon, 2002), with Newell, Acheampong and Worzala (2002) conducting an equivalent real estate research priorities survey for Australia in 2001. In 2003, equivalent real estate research priority surveys have been conducted in the U.K. (Newell, McAllister and Worzala, 2003) and Germany (Schulte, Newell and Worzala, 2003).Given these significant international real estate research developments, the purpose of this research is to compare the results of these four recent major international real estate surveys to examine the real estate research priorities of real estate fund managers in the U.S., U.K., Australia and Germany. Amendments to the year-old Security Guard Act have clarified onerous portions that at one time required every owner employing security guards to become a security guard company itself. Under the amendments, however, businesses and real estate owners still must register their security guards with the Dept. of State, which is responsible for the Acts enforcement. According to a Dept. of State memorandum, employers of security guards must file a notification form within 15 days of employment, retirement, resignation or termination of a security guard. “The guards have to comply but the company does not have to become licensed,” explained James F. McNicholas, senior vice president of Starrett Protective Services. “They have to be trained with an 8-hour entry-level training course and then 16 hours of on-the-job training.” One of the issues facing real estate owners is if in fact they are employing a “security guard” who is dressed in the clothing of a doorperson or porter. Advisories specifically exclude those employees functioning more than 50 percent of their time as a doorperson, superintendent, handyperson, porter, elevator operator, fire safety director and environmental safety person, among other job titles, from the training and registration requirements.

Over the past 18 years, the author has observed patterns in large income property loan portfolios during both inflationary and deflationary investment cycles. An inflationary investment cycle is when rents-prices for investment properties are increasing in aggregate. This inflationary trend occurred in the San Francisco Bay Area Tech Boom period from 1997 through 2000. A deflationary investment cycle is when rents-prices for investment properties are declining in aggregate. There is significant evidence to support a deflationary trend in the San Francisco Bay Area investment properties commencing 2001 with a 3- to 5-year duration.Income property portfolios react similarly to chaotic or non-predictive patterns in other investment portfolios such as stocks and bonds. The primary difference is that the time of change is very slow as measured in years in income property loan portfolios compared to the more volatile stock or bond portfolio reaction measured in days. This time difference is rather large since it typically takes 6 minutes to sell a stock versus 6 months on average to sell an income property. These “sell times” are averages from the point an investor decides to market an investment to the time net proceeds are received. Further, income property transaction times extend or contract depending on market conditions. Historically, income property is considered a safe, predictive investment alternative compared to the more volatile-chaotic stock or bond markets. Investor winners and losers are measured daily in the stock and bond markets, while income property portfolios are measured over years. Income property investments move so slowly that most investors believe it is predictable. Since the average “sell time” takes six months, deflationary pressures can have a significant negative impact on income property investments held over long periods of time. Predicting when or if deflation will hit a market is debatable between buyers and sellers. As it takes about 6 months to get out of a property, investors display a propensity to hold on longer during the beginning of deflationary cycles. Therefore, when it is time to sell, most investors have waited too long to capture the sales gain at the market top. Most investors discover when the top of the inflationary market occurred after they are already on the investment cycles down slope. When investors in aggregate believe it is time to sell, it is often too late as the top of cycle has already occurred. When investors try to sell on the down slope with vacancies increasing and with downward pressure on rental rates, it is very difficult sell since buyers typically have an uncertain outlook and are waiting on the sidelines for lower purchase prices. Spieker Properties, with the benefits of hindsight, selling to Equity Office is one example of a sale near the top of the inflationary cycle in February 2001. This transaction was observed by many CREs as the best-timed major income property portfolio sale in the San Francisco Bay Area marketplace.Given the recent 10-year investment cycle (1991-2001) in the San Francisco Bay Area, the first 5 year-period through 1996 was in aggregate deflationary for income investment properties purchased or refinanced from the previous inflationary period1986 through 1991. The last 5 years (1997 through 2001) was an inflationary period with rents/values in aggregate increasing on properties because of high demand for space related to the Tech-Boom economic expansion. Given existing lackluster demand with negative net absorption in the San Francisco Bay Area and given very high vacancy rates, the next five years will result for many property types deflationary pressures on rents/values for investment properties in aggregate. There will be exceptions. Some properties will not experience deflationary pressure in rents or investment sale prices because they have long-term leases backed by quality tenants occupying the entire property or are a “one-of-a-kind” superior location property.

cycle perspective, steel is the most effective material for reduced

Most debates about lawyers professional responsibilities ultimately devolve into discussions of the “role” of lawyers-including the functions lawyers serve in the legal system, how lawyers should achieve those functions, and how lawyers should reconcile conflicts between competing interests that are potentially affected by their conduct. The notion of a lawyers role can be helpful for identifying principles of behavior. Thus, for example, whether attorney-client confidentiality is appropriate and whether exceptions should be acknowledged depends on the conception of lawyers from which one starts. If lawyers are to be clients sole and fully-allied champions, then strict confidentiality rules make sense. If lawyers are to be objective intermediaries between clients and society and have independent obligations to the law, exceptions seem more acceptable. The task of code drafters is facilitated when they can proceed from the assumption that a single paradigm governs the lawyers role-either a paradigm encapsulating a theory of behavior (how lawyers ordinarily act) or a paradigm encapsulating a normative ideal (how lawyers should act). When code drafters rely upon multiple paradigms (for example, lawyers should act as clients alter egos and as officers of the court), inconsistent regulatory mandates can result, and lawyers may become confused about their functions. The ABAs 1908 Canons of Ethics, which prevailed in most American jurisdictions throughout the early twentieth century, suffered from an emphasis on inconsistent ideals.1 The bar was in a state of disagreement about lawyers roles and lawyers had no point of reference for determining how to act.2 Therefore, when the ABA adopted the first concrete professional code in 1969,3 it became important for the drafters to identify an over-arching theory. By emphasizing the lawyers place in the adversarial system, the 1969 code served a forceful unifying and educational function.4 Nevertheless, an ethics codes overemphasis on a single paradigm can lead to undesirable results. It tends to produce idealized rules that either rest on counter-factual assumptions or impose obligations on lawyers that are so inconsistent with their personal incentives that violations become routine. In modern times, an exclusive focus on the adversarial ethic seems less important than in 1969 because lawyers have developed a shared sense of core obligations to clients and of the part lawyers play in the legal system. The recent history of lawyer regulation reflects a desire on the part of the bar to fine-tune the basic message of the 1969 code-to recognize more nuances than, perhaps, a single image of lawyers can accommodate.5 The task of drafting professional rules is complicated by the fact that the public perception of the bar is not unitary. Society views lawyers in many different, and sometimes inconsistent, ways. These multiple conceptions influence code drafters. In practice, the modern legal ethics codes incorporate a number of “images” of lawyers as bases, or catalysts, for disciplinary rules. Relying on these images has consequences for how the codes treat lawyers and, as a theoretical matter, for how the rules should be drafted. Part I of this Article identifies some of the different images of lawyers that exist6 and the ramifications of emphasizing each image in the professional codes. Initially at least, this Article takes no position on the accuracy of the images in describing lawyer behavior-for example, whether lawyers act in a selfinterested manner or whether lawyers feel bound by unenforceable professional norms. As a practical matter, each of the images has solid footing in some respects. That is to say, each is based on a valid characterization of how lawyers act in some situations. Part I will suggest, however, that relying upon multiple paradigms inevitably fosters schizophrenia on the part of the code drafters.

Introduction Relevance to nursing recruitment and retention In 2002, the New Zealand Nursing Council workforce survey found that one-third of the actively practising registered nurses in New Zealand were aged between 40 and 50 years (Ministry of Health, 2003). With an ageing workforce and an ageing population overall it is desirable to encourage younger people to pursue careers in nursing (Marriner Tomey, Schwier, Martickefc. May, 1996). In the past five years, enrolments in the Whitireia Community Polytechnic Bachelor of Nursing programme have included an average of 15 students under 20 years old per intake - about 21% of the students enrolled each year. Brown and Matthews (2003) study on the impact of student debt on nurses found that only 13% of the students surveyed were under 20 years of age and nearly 33% were 40 years and over. While our programme has always targeted mature students, with the ageing workforce we now have a responsibility to recruit more young people into nursing.

Nicholas Brown. Utopian Generations: The Political Horizon of Twentieth Century Literature. Princeton: Princeton University Press, 2005. 1 + 235 pp. $26.95 In Utopian Generations: The Political Horizon of Twentieth Century Literature, Nicholas Brown proposes to refashion the relative literary and political positions occupied by modernism and postcolonial African literature. For Brown, Marxism illuminates the political vicissitudes of modernisms appropriation and subjection of the labor of African literature to the evaluative modes of literary theory as a final product of capital. Modernisms self-satisfaction and commoditization of the raw material and labor supplied by African literature, as well as African literatures often willing reconstitution of itself as eventual capital in a postcolonial market, get rectified in a utopian totality. There is an inverse relationship between utopias decline and the flowering of literary theory, all of which Brown argues is a historically causal effect of postcolonialism and consequently capitalism–of Hegels anthropological history. As Brown says, utopias totality hinges on “neither a literary history nor abstract universal history but on each texts relation to history itself” (3). Hegels emphasis on history serves as the utopic pretext under which both the modernist and African literary traditions realize their full meaning insofar as analyses of respective works in these traditions become structurally dialectic antimonies, each one deficient in political efficacy without the other. Capitalisms dialectical contradictions produce a social totality and reveal a utopian desire which Brown attempts to unveil in the complementarity of modernist and postcolonial texts such as the work of James Joyce and Chinua Achebe. Probing the essentially deconstructive agonism and rhetorical codependence of these literary genres certainly requires textual sensitivity and a skillful application of pre-existing theoretical modes. As textual analysis, Browns argument is distinguishable from his broader theoretical and political claims of a reinvigorated utopianism. Browns detailed reading of African literature, particularly Ngugi wa Thiongos play “I Will Marry When I Want” (1976) and Pepetelas A Geracao da Utopia (1993), is insightful, but its political significance and counterpoint to modernism may not engender the profitable new interpretive field Brown imagines–what he refers to as a sort of negative utopia. That is, Brown presumes a reading of Marx and Hegel unique enough to maintain a utopian framework sans any traditional positive thrust. A political and literary dialectic operates according to a negation which history and time, the full weight of historical dialectic, transform into a becoming-conscious of a positive vision of utopianism. History is, for Hegel, the transformative process of totality of negation into totality as utopic–the conflation of teleological ends with a contingent past in a total utopian moment. Brown readily confesses that history is a launching-off point for his supposed innovative notion of a negative utopia defined by an ephemeral space against which less violative assessments of modernism and African literature are made. If so, it is troublesome to maintain that the conclusion does not closely follow from the premise; and yet this is the crux of the political and literary work Brown envisions for utopia.
